Scrutia is an automated pre-audit tool that evaluates websites against WCAG 2.1 Level AA Success Criteria. It is not a legal opinion on ADA Title III compliance, does not guarantee immunity from demand letters or lawsuits, and does not replace consultation with a qualified US attorney. By placing an order you acknowledge that you understand these limitations.

These Terms of Sale (the “Terms”) apply exclusively to purchases made by customers located in the United States of America. By placing an order on scrutia.io, you acknowledge that you have read, understood and accepted these Terms.

1. Seller

The Scrutia service is operated and sold by its publisher, a company registered in France. Although the service is marketed to US customers, the seller of record is the French publisher. Full legal information about the seller (company name, registration number, registered office) is available in our legal notice.

2. Service description

Scrutia provides an automated accessibility audit of a website against the WCAG 2.1 Level AA Success Criteria. The standard deliverable is a multi-page audit report that includes:

  • Analysis of up to 10 key pages of the target website.
  • Detected non-conformities with severity ratings and code-level explanations.
  • Suggested remediations and prioritization guide.
  • Executive summary suitable for internal stakeholders.
  • A downloadable PDF report.

The audit is an automated technical assessment. It is not a legal opinion and does not replace a manual audit performed by a certified accessibility expert.

3. Price

The price of the full multi-page WCAG 2.1 AA audit report is $499 USD per audit, taxes not included. Applicable US state or local taxes (where legally required) are the responsibility of the customer. Prices are displayed in US dollars throughout the checkout process.

4. Payment

Payment is processed securely via Stripe and charged in US dollars (USD). Accepted payment methods include major credit and debit cards supported by Stripe. Payment is due upon ordering; the audit is generated after the payment has been successfully authorized.

Scrutia does not store any credit card information. All payment data is handled directly by Stripe, Inc., a PCI DSS Level 1 certified payment processor.

5. Delivery

The audit report is delivered digitally, by email, to the address provided during checkout. Delivery occurs within 24 hours of successful payment. In practice, most reports are generated and delivered within a few minutes. A secure download link, valid for 7 days, is included in the delivery email.

6. Refund policy

Due to the digital nature of the service and the immediate delivery of the audit report upon payment, all sales are final and no refunds are offered once the audit has been successfully delivered.

Automatic refund exception: If the audit fails to generate for technical reasons on our side (for example, our crawler cannot access the target website, the report generator throws an unrecoverable error, or the target website becomes unreachable during processing), a full refund will be issued automatically to the original payment method within 7 business days.

7. Monitoring Service (optional add-on)

The Scrutia Monitoring Service is an optional recurring subscription add-on (USD 99 per month) that performs an automated re-scan of your registered website every 30 days and emails you a PDF report with a diff of detected issues since the previous scan.

Disclaimer. The Monitoring Service performs automated scans on a fixed 30-day cycle. It does not guarantee real-time detection of accessibility regressions. Critical violations may exist between scan cycles. The customer remains solely responsible for ongoing accessibility maintenance, internal QA, and remediation effort outside of the Scrutia scan windows.

Subscription & Cancellation. Monthly Monitoring subscriptions auto-renew on the same calendar day each month. The customer may cancel at any time via the Stripe Customer Portal accessible from the magic-link page. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods. Read access to historical scans remains available after cancellation.

8. Governing law and jurisdiction

Scrutia is operated by a French company. Accordingly, these Terms are governed by French law and any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of Paris, France. We currently do not have a US-incorporated entity, which is why our home jurisdiction applies by default. Full legal information about the publisher is available in our legal notice. US consumer protections (see the paragraph below) remain fully preserved.

US customer statutory rights: nothing in these Terms limits or waives any non-waivable statutory rights you may have under applicable US consumer protection laws, including rules enforced by the Federal Trade Commission (FTC), and state-level consumer protection statutes such as the California Consumer Privacy Act (CCPA) where applicable. Where a mandatory rule of your state of residence provides greater protection than these Terms, that mandatory rule shall prevail.

9. Disclaimer regarding the ADA

Scrutia provides a technical accessibility audit against the WCAG 2.1 Level AA Success Criteria, which are widely used as a practical reference for digital accessibility in the United States.

The audit report is NOT a legal opinion on ADA compliance. The Americans with Disabilities Act (ADA) is a federal statute interpreted by US courts and the Department of Justice, and legal compliance determinations require qualified legal counsel.

US businesses facing ADA Title III lawsuits, demand letters, Department of Justice inquiries, or seeking a formal compliance opinion should consult a qualified US attorney. Running an audit with Scrutia does not guarantee immunity from ADA Title III lawsuits, demand letters, structured settlements, or regulatory actions. No accessibility tool, overlay, or automated report can provide such immunity.

Scrutia makes no representation that purchasing or implementing the recommendations of a Scrutia audit will result in ADA compliance or prevent litigation.

Pre-audit nature. Scrutia tests a fixed set of WCAG 2.1 Level AA Success Criteria using automated browser tooling. Approximately 40% of WCAG criteria require human verification (e.g. context- dependent alt text relevance, multi-page navigation consistency, screen reader user-flow validation) and are not covered by an automated pre-audit. A complete WCAG conformance evaluation requires manual testing by a qualified accessibility professional in addition to the Scrutia report.

10. Limitation of liability

To the maximum extent permitted by applicable law, the total cumulative liability of Scrutia, its officers, employees, and contractors, arising out of or related to the Scrutia service, the audit report, or these Terms — whether in contract, tort, strict liability, or otherwise — is strictly limited to the amount actually paid by the customer for the specific audit giving rise to the claim (i.e. up to USD 499 for a single one-shot audit).

No consequential damages.In no event shall Scrutia be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation lost profits, business interruption, loss of customers, attorney's fees, settlement costs, or judgments arising from ADA Title III lawsuits, demand letters, or regulatory actions, even if Scrutia has been advised of the possibility of such damages.

Indemnification.The customer agrees to indemnify and hold Scrutia harmless from any third-party claim arising out of the customer's use of, reliance on, or distribution of the Scrutia audit report, including without limitation claims by website visitors, plaintiffs, or regulatory bodies.

No warranty.The Scrutia service and audit report are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Scrutia does not warrant that the service will be uninterrupted, error-free, or that defects will be corrected.

Some US states (e.g. New Jersey) do not allow the exclusion or limitation of certain warranties or liabilities; in such states the limitations above apply only to the extent permitted by that state's law.

12. Data privacy

Personal data collected during the ordering process (email address, billing information, target URL) is processed in accordance with our US Privacy Policy. US customers retain their rights under applicable state privacy laws (including, where applicable, the CCPA).
