LOI 2023-171: France's EAA transposition

LOI n° 2023-171 of March 9, 2023 contains various provisions to adapt French law to EU regulations, including the transposition of the European Accessibility Act (Directive 2019/882). It was complemented by Ordonnance n° 2023-859 of September 6, 2023 and Décret n° 2023-931 of October 9, 2023, which together define the technical requirements, covered services, and enforcement mechanisms.

The DGCCRF can conduct audits, issue compliance orders, and impose fines. For public sector compliance, ARCOM and the Délégation interministérielle au numérique (DINUM) monitor compliance with the legal RGAA obligation.
What fines apply under the French EAA transposition?
Administrative fines reach up to €50,000 per violation identified, doubled for repeat offenses. The DGCCRF can also order compliance injunctions with daily penalties (astreintes), require the withdrawal of non-compliant services from the French market, and publicly disclose violations. For the public sector obligation to publish an accessibility statement, additional fines up to €50,000 apply under Article 47 of Loi 2005-102 as amended.
